Website Terms and Privacy Policy

Welcome to pan.pics (hereinafter: “the Website”). The Website is written and operated by Moti Pinhassi or anyone on his behalf (hereinafter: “the Website Manager”).

The Website serves as a blog for publishing handcrafted panoramas, where two products can also be purchased through the Website: a book and a postcard binder (hereinafter: “the Products”), or contact us to purchase a panoramic image or another service.

  1. General Provisions
    1. The provisions of these terms and conditions apply equally to both genders, and the use of the masculine form is for convenience only.
    2. The provisions of these terms and conditions and the terms of use appearing on the Website define the legal relationship between the customer and the Website, the terms of use of the Website and/or the ordering of products from the Website, and attest to the customer’s agreement to these terms and additional terms appearing on the Website.
    3. The Website Manager may, at any time, at their sole discretion, update these terms and conditions.
    4. These terms apply to the use of the Website and its services via any computer or other communication device (such as mobile phones, tablets, etc.). They also apply to the use of the Website, whether via the internet or any other network or communication means.
    5. Nothing in these terms and conditions shall derogate from the provisions of the Consumer Protection Law, 5741-1981 (hereinafter: “the Consumer Protection Law”) and the regulations enacted thereunder, insofar as they apply to the Website (hereinafter: “the Provisions”), except in cases where such provisions can be stipulated otherwise, and such stipulation has been made on the Website, whether explicitly or implicitly.
    6. The Website Manager makes every effort to present the most complete and comprehensive information regarding the product, including images. Notwithstanding the foregoing, it is clarified that inaccuracies and/or errors and/or omissions may appear on the Website in good faith and without malicious intent and/or with no intention to mislead, and the Website Manager shall not bear any responsibility arising from such inaccuracies and/or errors.
    7. The section headings are provided for the customer’s convenience and orientation and shall not be used in the interpretation of these terms and conditions.
    8. A clerical error in the description of a product/products shall not obligate the Website Manager.
    9. Product images on the Website are for illustration purposes only. Additionally, there may be differences in appearance, shade, size, etc., between the product as displayed on the Website and the actual product.
    10. It should be noted that in the preparation of handcrafted panoramas, there may be a slight deviation from the size declared on the Website, and there may also be variations in the assembly of the panorama, meaning the way images are glued together, including different cutting and horizontal and vertical adhesion order.
    11. It is forbidden to copy, use, or allow others to use, in any other way, content from the Website, including on other websites, in electronic publications, print publications, etc., for any other purpose without written permission from the Website Manager.
    12. The date recorded, for all intents and purposes, in the Website Manager’s computers shall be the decisive date for all matters.
  1. Website Registration
    1. There is no registration for the Website. For every purchase or contact, details must be re-entered.
  1. Product Purchase on the Website
    1. Product purchase will be made by adding products to the shopping cart. After adding products to the shopping cart, the customer will enter the following details in the designated online form during the order process: first name, last name, phone number, email address, locality, street, house number, floor, apartment, entrance, zip code, PO box if applicable, and any other identifying detail that can assist the delivery person in easily locating the property to which the order is being delivered, including notes and information regarding the shipping operation and/or if the recipient is not at home. Fields marked with an asterisk are mandatory, and without them, the order cannot be completed.
    2. To prevent any possibility of delivery failure, the customer must provide only accurate and correct details.
    3. Filling in all details is a prerequisite for placing the order to ensure efficient and error-free order processing, and therefore, all details must be provided accurately.
    4. The customer’s details will be updated according to the information provided in the online order form on the Website.
    5. The completion of all details required for product purchase by the customer shall be considered an order (hereinafter: “the Order”). Upon receipt of the Order, the Website will verify the credit card details, and only after approval by the credit card company and/or after receiving approval from PayPal, as clarified below, the transaction will be approved, and a final order confirmation will be issued. The customer will be charged for the product via credit card and/or PayPal account, as explained below, all subject to the availability of the products in the inventory of the Website Manager and the Website.
    6. The details as entered by the customer in the order form shall constitute conclusive evidence of the correctness of the actions.
  2. Payment Method for the Order
    1. Payment for the products shall be made by credit card or through an “electronic wallet” service account such as PayPal – (PAYPAL.COM) and any similar service, as may be available for use on the Website from time to time at the discretion of the Website Manager.
    2. If the customer chooses to use a credit card for payment, the customer will be asked to provide credit card details, ID number, expiration date, and the CVV.
    3. If the customer decides to pay via PayPal, the Website Manager will only be able to collect payment for the products after receiving approval from PayPal. The use and receipt of approval from PayPal are subject to the terms of use of the PayPal website.
    4. Credit card processing is operated by PayPal, therefore, the conditions from section 3 also apply to credit cards.
    5. The Website Manager reserves the right to discontinue the use of any payment method on the Website, to permit the use of additional payment methods, and to apply different payment arrangements to various types of credit cards or payment methods honored by the Website Manager.
    6. After the payment details have been entered in the online order form, the customer will receive an email confirmation acknowledging receipt of the order details. It is clarified that this confirmation does not obligate the Website Manager to supply the ordered products; it merely indicates that the order details have been received by the Website Manager.
    7. Immediately after placing the order, the Website’s embedded payment processing service will verify the payment method used by the customer, and the customer will receive an appropriate notification that the order has been approved and their account will be charged for the service.
    8. In the event that the transaction is not approved by the credit card company or by PayPal or any other payment processing company at that time, the customer will receive an appropriate notification, and the Website Manager will contact the customer to complete or cancel the transaction.
    9. Approval of the purchase transaction is conditional upon the availability of the purchased product in stock at the requested delivery date and/or at the time of order. If it was not stated that the product is out of stock and the product was not removed from the Website by the time the order was placed, the Website Manager shall not be obligated, provided that the Website Manager refunds the customer any amount paid, if paid to the Website Manager, and/or cancels the charge if it was made for the purchase transaction.
    10. It is clarified that there may be situations where, although an item is displayed on the Website as being in stock, it is actually unavailable and cannot be supplied. In such cases, the transaction will be canceled, and the customer shall have no claim in connection therewith, subject to the refund of the amount paid by the customer.
    11. The delivery date will be determined from the date of transaction approval by the credit card company or approval from the PayPal account or any other approved available electronic wallet service.
    12. If the customer was mistakenly charged by the credit card company or PayPal, the customer must notify the Website Manager to process a corresponding refund, via email to info@pan.pics.
  1. Delivery and Shipping of Products
    1. Product delivery by the Website will only be made after receiving payment approval from the credit card company and/or from the PayPal account, meaning the product has been paid for, as detailed above. The product will be supplied to the address the customer entered and/or provided when placing the order in the online form.
    2. The Website undertakes to deliver the goods within the delivery time frame to the requested destination and will do its utmost to ensure the product arrives quickly.
    3. The Website Manager will make every effort to deliver the products quickly, and the products will be delivered within 14 business days from the date of order receipt and approval if sent via registered mail, and within 3 business days if sent via courier. Product delivery times include only business days (Sunday to Thursday, excluding Fridays, Saturdays, holiday eves, and holidays).  
    1. Deliveries provided by the shipping company on behalf of the Website Manager are subject to the shipping company’s terms, its distribution areas, and prior coordination with the order recipient.
    2. Should the shipping company be unable to deliver to the shipping address for any reason, the Website Manager will notify the customer and work to find an alternative solution that satisfies both parties.
    3. In cases where products are supplied via Israel Post, to the shipping address provided by the customer when placing the order, the products will be shipped subject to Israel Post’s delivery times and are not subject to control by the Website Manager and/or suppliers.
    4. The delivery times specified on the Website and above do not apply to products that are out of stock on the Website and/or from the relevant supplier’s inventory.
    5. Shipping Fees – In addition to the price of the ordered products, the customer will be charged shipping fees; the amount of the shipping fees will appear at the end of the order process according to the shipping method chosen by the customer, unless otherwise stated.
    6. Shipping fees shall be paid with the product payment. For installment sales via credit card and/or PayPal account, the Website may collect shipping fees with the first payment charge.
    7. The Website shall not be responsible for any delay and/or postponement in delivery and/or non-delivery of products caused by any of the following reasons:
      1. Force majeure, and without derogating from the generality of the foregoing – war, military operation, emergency operation and/or natural disasters and/or events beyond the Website’s control such as general economic strikes and lockouts and/or at suppliers of services or goods required for product manufacturing, supply, or transport.
      2. Any reason beyond the control of the Website and/or the Website Manager.
      3. For a reason related to the delivery operator.
    8. The customer must immediately notify the Website if the product has not been delivered within the delivery period specified on the Website; in such a case, the new delivery time will be calculated from the date of coordinating a new date.
    9. Care must be taken to fill in accurate and up-to-date details; in the event that products are returned to the company due to incorrect details, the customer will bear the payment for shipping and handling fees. 
  1. Cancellation of Purchase by the Customer
    1. The customer may cancel the transaction in accordance with the provisions of the Consumer Protection Law and the regulations enacted thereunder. Without derogating from the foregoing:
      1. Cancellation shall be made solely by written notice to the email address info@pan.pics.
      2. Cancellation of a transaction by the customer will not be possible for the purchase of certain items as specified in subsection 14C(d) of the Consumer Protection Law.
      3. Cancellation of the transaction by the customer is subject to the product being returned, insofar as reasonable or possible, in its original packaging.
      4. Upon receipt of the cancellation notice, the amount paid by the customer for the product will be refunded, less a cancellation fee (shipping fees are not part of the product price and will therefore be deducted separately from the refund) at a rate of 5% of the transaction amount or NIS 100, whichever is lower. In the event of a transaction cancellation due to a defect or non-conformity, the customer will not be charged any cancellation fees. Additional provisions of the Consumer Protection Law regarding cancellation of purchase by the customer, including the obligation to return the product, shall also apply.
  2. Cancellation of Purchase by the Website Manager
    1. The Website Manager shall be entitled, at their sole discretion, for any reason, and at any time, to cancel or discontinue a transaction and/or sale and/or cancel an order, in whole or in part, and/or the Website’s activity, in whole or in part.
    2. Notice of such cancellation or discontinuation will be given to the user or customer, and the Website Manager will refrain from charging the customer’s credit card or will refund any amount paid for the products, if paid.
    3. Except for the refund of the transaction amount as stated, the user or customer shall have no claim, suit, and/or demand against the Website Manager and/or the supplier regarding the cancellation of the transaction as stated in this section.
    4. Should it be discovered that a product is out of stock, the Website may cancel the order or offer an equivalent alternative item. If an order is canceled as stated, the Website shall not be liable for any direct, indirect, consequential, or special damage caused to the customer or a third party, including but not limited to damage due to purchasing the item from a third party at a higher price.
  3.  Copyrights
    1. All intellectual property rights, including patents, copyrights, designs, models, and trade secrets, are the sole property of the Website Manager or other third parties who have authorized the Website Manager to use them.
    2. These rights apply, inter alia, to the data on the Website, including the product list, product description and design, and any other detail related to its operation.
    3. These rights also apply to the Website name and domain name (pan.pics) of the Website and previous domain names (holyglance.com, hapan.co.il), trademarks (whether registered or not) are all the property of the Website Manager. They may not be used without prior written consent.
    4. It is forbidden to copy, duplicate, distribute, sell, market, rent, or translate any information from the Website, including trademarks, images and texts, product design, product images, etc., without prior written permission from the Website Manager.
  1. It is forbidden to link to content from the Website that is not the Website’s homepage (deep link) and it is forbidden to display or publish such content in any way, unless the deep link is to the Website’s web page in its entirety and as is, so that it can be viewed and used in a manner completely identical to its use and viewing on the Website, without obtaining written consent from the Website Manager.
  2. The Website Manager may order the cancellation of a deep link even after granting consent, at their sole discretion, and in this case, there shall be no claim and/or demand and/or suit against the Website Manager.
  3. Some of the content was written with the assistance of artificial intelligence engines. If any text is found to infringe copyright and no credit is given, it was likely learned by the AI without my knowledge or malicious intent. You can  contact us and explain, and I will edit accordingly.

9.  Liability

  1.           The Website Manager (and/or anyone on their behalf) bears no direct and/or indirect responsibility for damages arising and/or related in any way to the repair, assembly, and/or replacement of the products.
  2.           The Website Manager (and/or anyone on their behalf) bears no direct or indirect responsibility for damages resulting from the use of and/or reliance on information published on external websites, which can be accessed through any of the services on the Website. It is clarified that the Website Manager makes and will make every effort to cooperate only with reliable and reputable suppliers.
  3.           The Website Manager (and/or anyone on their behalf) bears no direct and/or indirect responsibility for damages arising and/or related in any way to the use and/or performance of the Website.
  4.           In any case, the Website Manager shall not be responsible for any activity of any other entity not under their full control.
  5. Confidentiality and Privacy
    1. All personal details of the customer (name, email, etc.) will be stored in the Website Manager’s databases.
    2. The Website Manager will not transfer the customer’s personal details to any other party except to suppliers or delivery services, if necessary and solely for the purpose of completing a transaction.
    3. The Website Manager will not make any use of the customer’s payment method details except for processing payment for a transaction the customer requested to make, and these details will not be transferred to any other party except for this purpose. For the avoidance of doubt, payment method details are not stored in the Website Manager’s databases, nor do they reach them, but are processed directly by the clearing company (PayPal).
    4. Notwithstanding the foregoing, the Website Manager shall be entitled to transfer a user’s personal details to a third party in cases where the customer has committed an act or omission that harms and/or may harm the company and/or any third parties, the customer used the Website Manager’s services to commit an illegal act, if the Website Manager received a judicial order instructing them to provide the customer’s details to a third party, and also in any dispute or legal proceedings.
    5. The Website Manager may use the customer’s personal details, without identifying the specific customer, for the purpose of analyzing statistical information and presenting and/or providing it to other parties.
    6. Since operations are performed in an online environment, the Website Manager cannot guarantee absolute immunity against intrusions into its computers or the exposure of stored information by perpetrators of illegal activities. If a third party succeeds in penetrating information stored by the Website Manager and/or misusing it, the user shall have no claim, suit, or demand against the Website Manager.
    7. The Website Manager shall be entitled to use “cookies” to provide the user with a fast and efficient service.
    8. In cases beyond the Website Manager’s control and/or resulting from force majeure, the Website Manager shall not be responsible for any damage whatsoever, indirect or direct, caused to the customer and/or anyone on the customer’s behalf if this information is lost or if unauthorized use is made of it.
  1. Governing Law and Jurisdiction
    1. The law applicable to these terms and conditions and/or to any action and/or dispute arising therefrom shall be Israeli law only.
    2. In any case of dispute, the Magistrates’ Court of Netanya or the District Court of Tel Aviv-Yafo shall have exclusive jurisdiction to hear it.
    3. The law applicable to the use of the Website, the order, and these terms and conditions, including their interpretation and enforcement, shall be Israeli law only.
